Introduction:
Please take a moment to review the following to ensure you are happy to proceed with your booking.
By agreeing to a booking, you accept the terms of business below. If you have any problems, please make them known to us within 7 days of receiving this document; otherwise, the booking will proceed as agreed.
Where The Magical Story Elves are acting as the Entertainment Service Provider, and the booking contact is acting as The Hiring Client.
When acting as the Entertainment Service Provider, The Magical Story Elves are party to the contract as the supplier of entertainment services.
While we strive to accommodate all bookings, we understand that cancellations may occasionally be necessary.
In the event of cancellation due to circumstances beyond the control of either party (Force Majeure), neither party shall be responsible for any losses incurred. No fee will be payable by either party in this situation.
If an event is impacted by Force Majeure, the client may choose to reschedule the event within 3 months (subject to availability), and any monies already paid will be transferred to the new booking.
If The Hiring Client wishes to cancel a booking, the following charges will apply:
Payment is required within the following timescales to secure your booking:
Deposit payments are non-refundable within 59 days of the event unless the booking is cancelled by The Magical Story Elves or due to Force Majeure.
The balance must be paid in full by 14 days before the event to avoid cancellation.
All verbal agreements must be confirmed in writing or by payment of an invoice.
If the venue provided by The Hiring Client is unsuitable for the performance and the entertainer is unable to perform, the client will remain liable for the applicable cancellation charges.
If any performer is threatened, verbally abused or physically assaulted during the event, they reserve the right to stop the performance immediately without penalty. All agreed fees shall remain payable.
Should a delay occur due to the client’s actions, the entertainer is not obliged to extend the performance time or issue a refund.
The client must provide a suitable, safe performance area and ensure that any electrical equipment required meets current safety standards.
Outdoor performances are entirely at the client’s risk and are subject to suitable weather conditions.
The Hiring Client is responsible for providing a safe outdoor performance area together with an indoor alternative or suitable covered area should weather conditions become unsuitable, unless otherwise agreed in writing.
The Magical Story Elves reserve the right to refuse to perform outdoors where weather conditions may pose a risk to the safety of performers, guests, costumes, props or electrical equipment. This includes, but is not limited to:
Performers will not perform in direct rain or in conditions where costumes, props or electrical equipment could become damaged.
If a suitable alternative performance area cannot be provided, the booking will be treated as cancelled by the client and the applicable cancellation charges will apply.
The performance area must be level, clean, dry and free from hazards, with sufficient space for the booked entertainment.
To ensure children receive the very best entertainment experience and can fully engage with the activities, any bouncy castles, inflatable equipment, soft play areas and ball pits must not be in use during the entertainment.
Bouncy castles must be fully deflated, and soft play equipment and ball pits should be closed or made inaccessible for the duration of the performance.
These attractions create significant distractions and can also present unnecessary safety risks whilst children are taking part in interactive games, dancing and storytelling.
The Magical Story Elves reserve the right to pause, modify or discontinue the entertainment if these facilities remain in use during the performance.
No refunds or reductions in fees will be given where the quality of the entertainment is affected because these requirements have not been met.
To help keep everyone safe, we kindly ask that food, sweets and chewing gum are not consumed during the entertainment.
As children will be actively participating in games, dancing and interactive activities, eating during these activities presents a choking hazard and increases the risk of accidents.
Water may be consumed where required.
We recommend serving food before or after the entertainment, or during any agreed break.
If food is served during the entertainment, the performance may be paused until it is safe to continue.
The Hiring Client is responsible for ensuring that suitable parking or a designated unloading area is available for the entertainer as close to the venue as reasonably possible.
Where parking charges apply, these must either be arranged in advance by the client or reimbursed in full on the day of the event.
Any parking permits, access codes or venue-specific instructions should be provided before the event.
If suitable parking or access is unavailable, any delays caused will not extend the agreed entertainment time.
The entertainer will commence the performance at the agreed start time regardless of early arrival.
The client is responsible for ensuring the safety of all entertainer equipment throughout the event. Any damage caused to equipment by guests may result in the client being liable for repair or replacement costs.
Each entertainer can safely supervise and entertain a maximum of 30 participating children.
If more than 30 children are expected, an additional entertainer must be booked.
Where more than 30 children attend but only one entertainer has been booked, The Magical Story Elves reserve the right to modify the entertainment to ensure safety and fairness.
Any additional materials used because of unexpectedly high attendance may be invoiced following the event.
Face painting and glitter tattoos are carried out using professional cosmetic-grade products.
However, we cannot guarantee they are completely hypoallergenic.
The Magical Story Elves accept no responsibility for allergic reactions or skin irritation.
By proceeding with face painting or glitter tattoos, clients acknowledge and accept these risks.
The Hiring Client is responsible for ensuring the venue is safe and appropriate for the booked entertainment.
The Magical Story Elves will complete a brief safety assessment upon arrival and reserve the right to cancel, postpone or modify the performance if conditions are considered unsafe.
No refunds will be given where a performance cannot proceed because the venue has been deemed unsafe.
Both parties agree to comply with any applicable Government health and safety guidance in force at the time of the event.
At least one responsible adult (aged 18 or over) must remain present throughout the entertainment.
The Magical Story Elves are entertainers and are not responsible for supervising children outside of the activities provided.
The Hiring Client remains responsible for the behaviour and welfare of all children attending.
Any booking negotiated through The Magical Story Elves is subject to these Terms of Business unless otherwise agreed in writing.
No employee or representative may amend these terms without written authorisation.
The Hiring Client agrees not to engage Magical Story Elves performers directly for a period of 18 months following the last event.
All future bookings must be made through The Magical Story Elves.
Should a performer be engaged directly in breach of this agreement, The Magical Story Elves reserve the right to invoice the client for the unauthorised engagement together with any associated costs and losses.
These Terms of Business shall be governed by the laws of England and Wales, and both parties submit to the jurisdiction of the English courts.
