Terms Of Business

Introduction:

Please take a moment to review the following to ensure you are happy to proceed with your booking.

By agreeing to a booking, you accept the terms of business below. If you have any problems, please make them known to us within 7 days of receiving this document; otherwise, the booking will proceed as agreed.

Terms of Business:

Where The Magical Story Elves are acting as an Entertainment Service Provider, and the booking contact is acting as The Hiring Client.

When acting as an Entertainment Service Provider, Magical Story Elves is party to the contract as the supplier of entertainment services. 

Cancellations, Rescheduling & Making A Booking:

While we strive to accommodate all bookings, we understand that cancellations may be necessary. The following policy applies in such cases:

Cancellation Policy: 

  1. In the event of cancellation due to circumstances beyond the control of either party (force majeure), neither party shall be responsible for any losses incurred. No fee will be payable by either party in this situation.
    • If an event is impacted by force majeure, the client has the option to reschedule the event within [3] months instead of cancelling. This is subject to availability, and any deposit paid will be applied to the rescheduled event.
  1. If The Hiring Client wishes to cancel a booking, the following charges apply:
    • More than 60 days before the event: No Fee
    • 15-59 days before the event: 50% of Total Invoice
    • Less than 15 days before the event: 100% of Total Invoice

Payment Terms:

  1. Payment is required within the following timescales to secure the booking:
    • Deposit Payment (50%) – Due within 7 days of receiving the invoice.
    • Outstanding Balance – Due 14 days before the event via BACs or PayPal, unless otherwise agreed.
    • Bookings made within 14 days of the event – Full payment is required upfront.
  1. Deposit payments are non-refundable within 59 days of the event, except in cases of cancellation by Magical Story Elves or force majeure.
  1. The balance must be paid in full by 14 days before the event to avoid cancellation.
  1. All verbal agreements must be confirmed in writing or by the payment of an invoice.
 Performance & Venue Requirements:

  1. If the venue provided by The Hiring Client is unsuitable for the performance, and the Act(s) is/are unable to perform, the client will be liable for cancellation charges. This includes outdoor events cancelled due to weather.
  1. If any Act is threatened, abused verbally or physically during the event, they are entitled to cease the performance without penaltyAll fees remain payable.
  1. Should a delay occur due to the client’s actions, the performer is not obligated to extend the performance duration or issue a refund.
  1. The client must provide a suitable performance area and ensure that any electrical equipment required meets industry standards.
  1. To ensure an optimal entertainment experience, all bouncy castles must be fully deflated during the performance, as they can be a distraction to both entertainers and guests.
  1. The entertainer will commence the performance at the pre-arranged time, regardless of early arrival at the venue. Performances will not begin ahead of schedule.
  1. The client is responsible for ensuring the safety of all entertainer equipment. Any damage occurring during the event may result in liability for repair or replacement costs.
  1. Number of Children & Additional Entertainers:
  • Each entertainer can manage a maximum of 30 children.
  • If the number of children exceeds 30, the client must book an additional entertainer.
  • If more than 30 children are present and only one entertainer has been booked, the client will be liable for any additional materials used, and these costs will be invoiced accordingly after the event.
 

Face Painting & Glitter Tattoo Terms:

  1. Face painting and glitter tattoos are applied using professional, skin-safe products. However, we cannot guarantee that they are completely hypoallergenic.
  1. We do not apply face paint or glitter tattoos to children under 3 years old or individuals with contagious skin conditions.
  1. Clients must inform the artist of any known allergies or skin sensitivities before application.
  1. Face paints and glitter tattoos are temporary and will naturally fade or wash off over time.
  1. The company is not responsible for any allergic reactions or skin irritations that may occur as a result of face painting or glitter tattoos.
  1. The artist reserves the right to refuse service if hygiene or health concerns arise.
  1. Glitter tattoos typically last 3-7 days and can be removed using baby oil or rubbing alcohol.
  1. By proceeding with face painting or glitter tattoos, clients accept these terms and acknowledge the potential risks.

 

Health & Safety:

  1. The Hiring Client is responsible for ensuring that the venue is safe and appropriate for the booked entertainment.
  1. The Magical Story Elves team will conduct a brief safety assessment upon arrival and reserves the right to cancel or modify the performance if conditions are deemed unsafe. Refunds will not be issued if a performance is canceled due to unsafe conditions.
  1. The hirer and the performer must abide by all current Government COVID Guidelines to ensure safety.
  1. Adult Supervision at Children’s Events:
  • The Hiring Client must ensure that at least one responsible adult (over 18) is present at all times during the event to supervise the children.
  • The Magical Story Elves are not responsible for child supervision and will not be held liable for any incidents resulting from lack of supervision.

General Terms:

  1. Any booking negotiated through this Entertainment Service Provider shall be subject to these Terms of Business, unless otherwise agreed in writing.
  1. No agent or representative of Magical Story Elves may vary these terms without written authorisation.
  1. The Hiring Client agrees not to engage Magical Story Elves performers directly for future events. All bookings must be made through Magical Story Elves for a period of 18 months following the last service provided. Should it be found that a performer has been engaged directly in breach of this agreement, the company reserves the right to issue an invoice for the unauthorised engagement, including any associated costs.
  2. These terms are governed by English Law, and both parties submit to the jurisdiction of the English courts.
